Montenegro Court Confirms Five-Year Sentence for Rape Conviction

The Appellate Court of Montenegro has upheld a five-year prison sentence for M.J., convicted of rape. The decision, confirmed on March 15, 2024, dismissed appeals filed by both M.J. and his legal representative, citing the original ruling as sound and justified.

The Higher Court had previously found M.J. guilty of the crime and sentenced him accordingly, taking into account the time already served in pre-trial detention. The Appellate Court reviewed the case thoroughly and determined that the objections raised in the appeals lacked merit.

In its decision, the Appellate Court stated, “The first-instance verdict, contrary to the allegations in the appeals, does not contain substantial violations of criminal procedure provisions, as the first-instance court based its decision on valid reasons and factual conclusions.” The court affirmed that these conclusions were entirely logical and comprehensible, thereby reinforcing the integrity of the original ruling.

The Appellate Court also examined the sentencing details, noting that the first-instance court had properly assessed the circumstances influencing the choice of criminal sanction. It found that the imposed prison sentence is appropriate given the severity of the crime and the degree of M.J.’s culpability. The court emphasized that the sentence aimed to fulfill the general objectives of criminal penalties.
