Couples Clash Over Cars in Rising ‘Carstody’ Disputes
As relationship breakdowns become increasingly contentious, a new phenomenon known as “carstody” is emerging, with couples fighting over vehicle ownership after a split. Research indicates that approximately 70% of partners in the UK who share a car have experienced disputes regarding who retains ownership post-breakup. These disagreements can escalate quickly, with some individuals admitting to damaging vehicles during arguments.
The term “carstody” reflects a shift from traditional disputes over children and pets to conflicts surrounding shared assets, particularly cars. Data from the used car marketplace Cazoo revealed that 34% of couples failed to discuss ownership arrangements when purchasing a vehicle together, leading to confusion and conflict. Notably, Gen Z individuals are the most likely to resort to vandalism, with a quarter admitting to damaging a car due to disputes over it.
Introducing the ‘Brake-Up Clause’
In response to these troubling trends, Cazoo has introduced the UK’s first “Brake-Up Clause” guide, aimed at helping couples navigate the complexities of shared vehicle ownership during breakups. The guide has been developed in partnership with Estella Newbold-Brown, a legal expert specializing in shared ownership disputes.
Lucy Tugby, Cazoo’s marketing director, emphasized the importance of having a pre-agreed plan. “Cars are often the silent casualty of a breakup. They’re financially valuable and essential to everyday life, which means that disagreements can escalate quickly,” she stated. Tugby believes that addressing these issues before they arise can enable couples to make rational decisions and potentially prevent unnecessary conflict.
Newbold-Brown echoed this sentiment, highlighting the financial significance of vehicles. “Apart from your home, your car might be among one of the most expensive purchases in your lifetime — and equally vulnerable if your relationship comes to an unexpected end,” she explained. She advises that couples should plan for potential breakups while they still have control over their assets.
Legal Insights on Asset Distribution
In the event of a relationship ending, the courts have extensive powers to redistribute assets, which can include personal property like cars. Newbold-Brown noted that courts often prefer negotiation or mediation to resolve such disputes, as they seek to avoid lengthy legal battles.
Formal agreements prepared with professional assistance can help clarify ownership and reduce uncertainties. Newbold-Brown suggests that a car-specific Nuptial agreement or a car-specific Cohabitation agreement may prove beneficial for couples living together. However, she warns against DIY agreements, which may not be upheld in court due to specific legal criteria that must be met.
The rise of “carstody” disputes highlights the need for couples to address shared assets proactively. As relationships evolve, so too do the complexities surrounding ownership and financial responsibilities. By engaging in open discussions and creating formal agreements, couples can mitigate the emotional toll of breakups and protect their financial interests.
As the landscape of personal relationships continues to shift, understanding the implications of shared ownership can help foster more amicable separations, ultimately benefiting both parties involved.
