UK’s First Out Trans Judge Challenges Supreme Court Ruling

Victoria McCloud, the United Kingdom’s first openly transgender judge, is taking legal action against the British government by seeking a rehearing of a controversial Supreme Court ruling. This case revolves around the definition of “sex” under the Equality Act 2010, which the court determined applies solely to “biological women.” McCloud, who retired in 2024 and now works as a litigation strategist at W-Legal, claims that her rights to a fair trial were compromised when the court did not allow her to present evidence or representation from the transgender community.
In April 2024, the Supreme Court ruled in favor of the gender-critical group For Women Scotland in a case against the Scottish government. The justices concluded that the terms “woman” and “sex” within the Equality Act refer explicitly to biological sex, thereby excluding transgender women from legal recognition. While proponents of the ruling hailed it as a victory for women’s rights, numerous human rights and LGBTQ+ organizations issued warnings that the decision would further marginalize transgender individuals in society.
Since the ruling, the Equality and Human Rights Commission has proposed draft guidelines that could restrict transgender people from accessing single-sex spaces and services that align with their gender identity. Leaked documents suggest that the final version may not differ significantly. Several organizations, including the Football Association and the England and Wales Cricket Board, have already begun measures to exclude trans individuals from specific areas.
Legal Challenge Based on Human Rights
McCloud’s application to the European Court of Human Rights (ECHR) cites Articles 6, 8, and 14 of the ECHR, which protect the right to a fair trial, respect for private life, and freedom from discrimination, respectively. In her words, “No representation or evidence had been included from us in the 8,500 group [the estimated UK population of people with Gender Recognition Certificates who are diagnosed as transsexual]. I was refused. The court gave no reasoning.”
A spokesperson for the Trans Legal Clinic emphasized the necessity of inclusion in legal discussions affecting the transgender community, stating, “There must be no more conversations about us, without us.” This legal initiative is supported by a community crowdfunding campaign designed to cover the costs associated with the case, reflecting widespread public interest in the issues at stake.
In June 2024, McCloud engaged international organizations such as Genocide Watch and The Lemkin Institute to examine the state of transgender rights in the UK. During a keynote speech at the Pride In London Human Rights Forum, she lamented the “systematic oppression” faced by the trans community, highlighting issues such as bathroom bans, violence, and social exclusion.

McCloud’s legal actions come at a critical time, as For Women Scotland has announced plans for further legal action against the Scottish government regarding policies perceived as overly inclusive of transgender individuals. This ongoing conflict illustrates the deep divisions within society regarding gender identity and rights.
