Imo State Legal Dispute Sparks Questions Over Court Jurisdiction
The legal system in Imo State is currently facing scrutiny due to a complex jurisdictional issue involving a case that has been moved from a Magistrate Court to a Customary Court. The matter, which is already active in the Ahiazu Mbaise Magistrate Court, was unexpectedly reintroduced in the Ahiazu Mbaise Customary Court by the respondent, Ugochukwu Anyanwu. This dual proceeding raises significant questions about legal protocol and jurisdiction.
The original case involves allegations against Ugochukwu Anyanwu and five others, pertaining to a three-count charge of stealing and destruction of property associated with a construction project owned by Cyprian Ugo in the Oru Ahiara Community. Court documents indicate that the defendants face serious legal repercussions, yet the situation took an unusual turn when Anyanwu initiated an identical case in the Customary Court.
Legal experts are puzzled by how a matter already in the jurisdiction of the Magistrate Court could also be entertained by the Customary Court without a formal order or an appeal process.
