NHS Fife Mandates Staff Toilet Usage Based on Biological Sex

NHS Fife has announced a new policy requiring its staff to use restroom facilities that correspond with their biological sex, rather than their gender identity. This decision comes after a legal directive from the UK’s Equality and Human Rights Commission (EHRC), which mandated that the health board take immediate corrective actions regarding single-sex spaces.
In a recently published equality impact assessment, NHS Fife outlined its interim position. The health board stated that it will provide a mix of suitable facilities that comply with legal standards. The assessment specifies that “where toilets and changing facilities are not in individual separate lockable rooms, separate toilets and changing facilities will be provided for men and women alongside additional gender-neutral facilities.”
The document emphasizes that facilities designated for men and women should be used by individuals whose sex at birth aligns with the designated facility. It also highlights the importance of ensuring that “no one should be put in a position that they do not have access to suitable facilities that respect and protect their dignity and privacy.”
Concerns were raised in the assessment regarding the potential risk of “outing” individuals undergoing gender reassignment if access to gender-neutral facilities is limited or poorly located. The report also notes that the workforce at NHS Fife is predominantly female, which increases the demand for women’s facilities. It warns of the possibility of “indirect sex discrimination” if women’s facilities are inadequate, distant, or lack sufficient privacy.
The EHRC’s involvement stems from an ongoing legal case involving nurse Sandie Peggie, who was suspended after raising concerns about sharing a changing room with Dr. Beth Upton, a transgender medic, at Victoria Hospital in Kirkcaldy on December 24, 2023. Peggie has since filed a claim against NHS Fife and Dr. Upton, citing violations of the Equality Act 2010, including sexual harassment, harassment related to a protected belief, indirect discrimination, and victimization. The case is currently adjourned until September 2024.
In a statement issued on September 30, 2023, NHS Fife reaffirmed its commitment to providing safe and lawful facilities that respect the privacy and dignity of all staff members. The health board acknowledged that no prior equality impact assessment had been performed and that one was commissioned retrospectively following the UK Supreme Court’s ruling in April, which clarified the definition of a woman under equality law as referring to biological sex.
NHS Fife emphasized that the newly published equality impact assessment is part of its ongoing review of staff changing and toilet facilities across its estate. The review aims to ensure compliance with legislative and regulatory requirements while providing an appropriate mix of single-sex, gender-neutral, and accessible facilities.
As NHS Fife continues to assess its facilities, it plans to engage with staff and partners to ensure they remain fit for purpose and aligned with current legislation and guidance. The health board’s proactive approach aims to balance the needs of its diverse workforce while adhering to legal mandates.
