Man Sentenced for Possession of Over 4,000 Indecent Images
A 26-year-old man, Gary Devaney, has been placed under supervision for three years after being found with more than 4,000 indecent images of children. The sentencing took place at Lerwick Sheriff Court following a police investigation that revealed a significant amount of explicit content on his devices.
On January 13, 2025, law enforcement officials conducted a search of Devaney’s home in Burra, acting on a tip-off regarding his online activities. The investigation uncovered a total of 4,273 unique still images and 227 videos, which amounted to a combined runtime of six hours. The court learned that during police interviews, Devaney made several admissions, stating he had unintentionally accessed the material and subsequently developed an attraction to it.
Although Devaney insisted he stumbled upon the indecent images, a detailed cyber crime report presented in court revealed a broader pattern of behavior. Investigators found not only accessible images but also additional files that had been deleted prior to the police search, indicating a deliberate attempt to conceal his actions.
Devaney admitted to possessing indecent images of children between June 25, 2023, and January 13, 2025. He also acknowledged taking or permitting the taking of further photographs from November 20, 2021, to January 20, 2025, and distributing images between October 12, 2024, and January 6, 2025.
Defence attorney Tommy Allan argued during sentencing that Devaney recognizes the severity of his offenses and feels “deeply ashamed” of his actions. Allan highlighted that Devaney had spent excessive time online, which led to his troubling behavior. He further noted that Devaney is committed to addressing his issues and has begun working with the Lucy Faithfull Foundation, an organization dedicated to preventing child sexual abuse.
Sheriff Ian Cruickshank decided on a community payback order for Devaney, emphasizing that this sentence serves as a direct alternative to imprisonment. As part of his sentence, Devaney is also required to complete 200 hours of unpaid work over the next year and will be included on the sex offenders register for a duration of three years.
This case highlights the ongoing challenges law enforcement faces in combating online exploitation and underscores the importance of proactive measures to protect vulnerable children from potential harm.
