Scottish Justice Secretary Defends Early Prisoner Releases Amid Criticism
The early release of prisoners in Scotland has sparked significant concern among victims of crime, as emphasized by Justice Secretary Angela Constance. On December 9, 2023, the government plans to release up to 84 criminals as part of an initiative aimed at addressing the growing prison population, which reached a record high of 8,441 in November.
Constance noted that the early release program is limited to individuals nearing the end of their sentences. Importantly, those convicted of serious offenses, such as domestic abuse or sex crimes, will not be eligible for this scheme. Furthermore, prison governors will have the authority to veto any early releases, ensuring that only appropriate cases are considered.
Over the next five months, the Scottish Government anticipates that as many as 990 prisoners could be released early. This follows a previous round in which more than 400 individuals benefited from the program. Constance acknowledged the sensitive nature of this decision, stating, “I can assure you that this isn’t a decision that I took lightly.”
The Justice Secretary discussed the necessity of the early release scheme during an appearance on the BBC Radio Scotland Breakfast program. She highlighted that the government is focused on “longer term solutions” to the issue of overcrowding in prisons. Nonetheless, the immediate need for action has prompted this measure.
“The legal requirement for our prisons to be safe for staff and prisoners is paramount,” Constance explained, acknowledging that for victims, this news may feel like “cold comfort.” She emphasized that those released are individuals who would soon return to their communities regardless.
Constance also attributed delays in constructing new prisons to factors beyond the government’s control, including the Covid pandemic, inflation, and issues with supply chains. She pointed out that, despite an increase in prison capacity by approximately 400 over the past year, simply building new facilities will not solve the problem of overcrowding.
As the Scottish Government navigates these challenges, the discussion surrounding prisoner release policies continues to evoke strong reactions from various stakeholders. The balance between ensuring public safety and addressing prison overcrowding remains a contentious issue within the justice system.
